Acceptable Use PolicyThis Acceptable Use Policy applies to all persons and entities("Customer") using the servers, services, products or other facilities of Quost/OnLineTour, including but not limited to, web hosting, server solutions and related Internet services ("Services or Products"). This policy is designed to protect the security, integrity, reliability, and privacy of both Quost/OnLineTour's Services or Products, the network and services of Quost/OnLineTour's upstream providers and the Services or Products Quost/OnLineTour offers to its customers. Important NoteQuost/OnLineTour may immediately terminate Customer's Services or Products, or (at Quost/OnLineTour's sole option) suspend, interrupt or terminate one or more Service(s) to which such breach pertains for violation of any provision of the Acceptable Use Policy WITHOUT WARNING OR PRIOR NOTICE. Notification via email will accompany account or service suspension or termination. Quost/OnLineTour will attempt to work with our customers to cure violations of this policy and ensure that there is no re-occurrence; however, Quost/OnLineTour reserves the right to suspend or terminate Customer's Services or Product based on a first offense. Quost/OnLineTour, in its sole discretion, has the right to discontinue service, or deny access to anyone who violates the Acceptable Use Policy or Terms and Conditions Any unauthorized use of any service, product or computer by Customer, including but not limited to, unauthorized access, password breaches, DoS attacks, virus attacks, whether or not the misused service, product or computer belongs to Quost/OnLineTour, will result in action against Customer. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the misuse. Unacceptable use includes, but is not limited to, any of the following:1. Posting, publishing, transmission, re-transmission, or storing material by Customer, or through the Customer or Customer's Service(s) or Product(s) by a third party, to or through any of Quost/OnLineTour's Services or Products in connection
with Customer's use of the Services or Products, if in the sole judgment of Quost/OnLineTour such posting, publishing, transmission, re-transmission or storage is: 2. Using Quost/OnLineTour products or services for sending or distributing any form of "bulk email", spam, UCE, or any unauthorized email, including but not limited to; advertising using bulk email techniques, unsolicited email messages, "chain letters", "pyramid schemes", junk email, spamming, any use of distribution lists to any person who has not given specific permission to be included in such a process, or the distribution of other advertising material to individuals who did not specifically request such material, who were not previous customers of Customer or with whom Customer does not have an existing business relationship. 3. Usage, installation or distribution of software or other products that are not appropriately licensed or permitted for use, installation or distribution by Customer. This includes but is not limited to warez, cracks, software serial numbers, unlicensed or copyrighted software, MP3's, movies and games. 4. Actions that restrict or inhibit anyone, whether a customer of Quost/OnLineTour or otherwise, in his or her use or enjoyment of Quost/OnLineTour products and services, or that generate excessive network traffic or server load through the use of automated or manual routines that are not related to ordinary personal or business use of the Services or Products provided. 5. Introduction of malicious programs into the Quost/OnLineTour servers, network or other Services or Products provided by Quost/OnLineTour (e.g., viruses, trojan horses and worms). These include but are not limited to programs that contain viruses or other computer programming defects, which result in damage to Quost/OnLineTour or any third party. 6. Installation, distribution or using software or products that are not appropriately licensed or approved for use by the customer. 7. Causing or attempting to cause security breaches or disruptions of Internet communications. Examples of security breaches, include but are not limited to, accessing data of which Customer is not an intended recipient, logging into a server or account that the customer is not expressly authorized to access or using any program/script/command designed to interfere with, or to disable a user's terminal session. Examples of disruptions include but are not limited to port scans, flood pings, DOS and DDOS attacks, packet spoofing and forged routing information. 8. IRC services or content of any kind, to include but not limited to eggdrops, shells and servers, or any material related to IRC or promotion of IRC related services. 9. Deceptive marketing practices. 10. Executing any form of network monitoring that will intercept data not intended for Customer. 11. Circumventing user authentication or security of any host, network or account. 12. Harassment, whether through language, frequency, or size of messages. 13. Unauthorized use or forging of mail header information. 14. Furnishing false or incorrect data on the order form and/or contract, including fraudulent use of credit card numbers. 15. Attempting to circumvent or alter the processes or procedures used to measure, bandwidth utilization or other methods to document "use" of Quost/OnLineTour's Services or Products. 16. Providing, hosting or using Adult rated or classified material to include, but not limited to, child porn, rape, torture, murder. (Special provisions and servers may be available for legal Adult oriented services, but customer must contact Quost/OnLineTour with their requirements before such services are permitted.) 17. Resale of Quost/OnLineTour Services or Products without the express prior written consent of Quost/OnLineTour. Resold Quost/OnLineTour Services or Products are subject to the Acceptable Use Policy and Terms and Conditions, and reselling customers must ensure their clients accept and follow said policies and conditions. No failure or delay in exercising or enforcing this policy shall constitute a waiver of the policy or of any other right or remedy. If any provision of this policy is deemed unenforceable due to law or change in law, such a provision shall be disregarded and the balance of the policy shall remain in effect. Changes and AgreementQuost/OnLineTour reserves the right to modify this policy at any time, effective immediately upon posting of the modification. Your use of Quost/OnLineTour products and services constitutes your acceptance of the Acceptable Use Policy in effect at the time of your use. You are solely responsible for any and all acts and omissions that occur during or relating to your use of the service, and you agree not to engage in any unacceptable use of the service.
